According to the above public offering, around July 26, 2013, the Defendant purchased a F rocketing car from E located in Gwangju-si Mine-gu, Gwangju-si, and the fact is that the Defendant thought the said car to be “motor vehicle seat” and did not have the intent or ability to pay the card price normally, the Defendant applied for the so-called “specific limit” service that temporarily increases the lending limit of credit cards to Hyundai Card Co., Ltd., which is the victim through his employees, and then applied for the so-called “specified limit” service that temporarily increases the lending limit of credit cards to Hyundai Card Co., Ltd., which is the victim through his/her employees, made payment on the credit card price settlement date of the following month.
However, since the defendant did not have any particular property at the time, even if the victim would be able to purchase a car by raising the specified limit of the card, there was no intention or ability to pay the price by a lump sum payment on the date of settlement of the card price for the following month.
As such, the Defendant, by deceiving the victim and obtaining approval of the “specified Limit” from the victim, paid 30 million won for the purchase of the said rocketing car by the said card, and did not pay the card price, thereby obtaining pecuniary benefits equivalent to the said amount.
