A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On July 2014, the Defendant collected victims from the Internet website “W.Smethink.com” (www.S.com) and on the cell phone display bulletin board “franum franchising”, which reads that the victims may be punished by money when opening an illegal sports gambling site to the victims. The Defendant received investment money from the victims for the cost of opening an illegal sports gambling site and building a server. From around that time until September 2014, the Defendant repeatedly posted the above contents on the Internet website and its neighboring bulletin boards.

However, even if the defendant did not open or operate an illegal sports gambling site, and even if he received money from the victim, he did not have the intent or ability to open and operate an illegal sports gambling site.

The defendant is responsible for establishing illegal sports gambling sites and servers from the victim.
