1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Details of the disposition;
A. The Plaintiff is a local public official who was appointed as a public official on May 6, 1996 and served in the Chuncheon Education Support Agency from July 1, 2019 to December 31, 2019 and was engaged in B’s duties (class 6 local educational administrative officials).
B. On March 10, 2020, the Defendant violated the duty to maintain dignity under Article 55 of the Local Public Officials Act by the Plaintiff on the following grounds:
On the other hand, local public officials made a disposition of "one month of salary reduction" in accordance with Article 69 of the Local Public Officials Act (hereinafter "the initial disposition"). On October 1, 2019, the Plaintiff proposed that the office of education and the service performance rating unit should be submitted to other kindergartens or elementary schools.
C said that “I wish to think,” and submitted a written statement of transfer on October 14, 2019.
After December 6, 2019, C revoked the internal transfer notification and approved the approval on December 9, 2019 with the exception of himself from the list of transfer priority.
On December 10, 2019, the following day, the Plaintiff demanded C to reconsider the revocation of the transfer approval, and instructed C to recover the approval (hereinafter “reasons for disciplinary action 1”). On December 3, 2019, the Plaintiff sent the Plaintiff’s erroneous sending the Plaintiff’s reply to “D and Montreal” to other employees for the instant business purposes on December 3, 2019.
On December 4, 2019, the Plaintiff expressed an decentralization under the separate name of “D” by separately providing the employees in charge of B, and sent C the word “A” (hereinafter “grounds for disciplinary action 2”). On November 15, 2019, the Plaintiff sent the inappropriate text message to C, including “Ma,” “I,” “I,” “I,” “I,” and “I, see, e-mail, I, and “I, see, e-mail,” “I,” and “I, e-mail,” respectively (hereinafter “grounds for disciplinary action 3”).
The plaintiff is dissatisfied with the original disposition.
