The grounds of appeal are examined.

Examining various circumstances, such as the Defendant’s age and character environment, relationship with the victim, motive means and consequence of the instant crime, and the circumstances after the instant crime, etc., the determination of the sentence by the lower court, which maintained the first instance judgment that sentenced 18 years to the Defendant, even if considering the circumstances asserted on the ground of appeal, is extremely unfair.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
