Reasons
Punishment of the crime
On July 28, 2009, Defendant A was sentenced to six months of imprisonment for a crime, etc. in the Suwon District Court’s Ansan Branch on July 28, 2009, and the judgment became final and conclusive on August 5, 2009. Defendant B was sentenced to six months of imprisonment for a crime of fraud and two years of suspended execution on June 11, 2009 by the same court, and the judgment became final and conclusive on October 23, 2009.
【Criminal Facts】
Defendant
B around February 15, 2007, the victim G was punished for money by sending 1200 tons in cash or in bills to the victim G. The Defendant A and B stated that “on the loan of money to B, the cash will be allowed to be attached.” The Defendant A and B provided the victim I in Seocho-gu Seoul Metropolitan Government H around March 15, 2007 that “on the receipt of 1,200 tons in steel work, and the delivery was not possible due to lack of money. If only KRW 100 million is lent, the amount of money will be added to KRW 70 million within a week by shipping 1,200 tons in steel work.”
However, Defendant A and B did not have a certificate of delivery for 1,200 tons of steel, and even if they received money from the victim for the purchase of steel, they had the intent to use them for their personal debt repayment and other business purposes, and there was no intention or ability to pay the borrowed money and its profits at the time promised to the victim.
Defendant
A and B conspiredd the victim as above, and received 70 million won in total from the victim, i.e., 10 million won cashier's checks.
