Punishment of the crime

1. Around November 26, 2018, the fraud Defendant reported that “I will deliver goods to the Defendant on the Internet if I would deliver the money first if I would deliver the money.”
However, due to the fact that the defendant did not have the above new requisition, the defendant did not have the intention or ability to send the new requisition even if he receives the price.
As above, the Defendant, by deceiving the victim as above, received KRW 300,00 from the victim to the F account (G) in the name of the Defendant on the same day. From around that time to June 10, 2019, the Defendant, as well as by deceiving the victims or the victims, who posted an article on which goods were sought, by reporting the article on the goods from around that time to June 10, 2019, and by deceiving them by the said method, and received a total of KRW 12,02,000 from the 35 victims as shown in the annexed Table 1.
Accordingly, the suspect was provided property by deceiving the victims.
2. No person, other than the Seoul Olympic Sports Promotion Foundation or an entrusted business entity, shall engage in any act of offering property or property benefits (hereinafter referred to as "similar act") to persons who win at the betting place by issuing sports betting tickets or similar things, and no person shall engage in gambling using such prohibited act;
Nevertheless, the Defendant subscribed to “H” and “I”, a similar act operated by the winners of his name (hereinafter “illegal sports soil”), as a member. From February 11, 2019 to June 18, 2019, he remitted total of KRW 19,980,000 to the game money charging account of the above site as shown in attached Table 2, as shown in attached Table 2, from around February 11, 2019 to June 18, 2019, charged the game money with the amount of KRW 19,980,000, and then charged the deposited game money with the betting rate determined according to the result of the sports game in Korea and abroad.
