Basic Facts

On June 26, 2013, the Plaintiff: (a) attached a provisional attachment (hereinafter “the instant product payment claim”) against the Defendant of the UNTech Co., Ltd. (hereinafter “NEC”); and (b) the original copy of the said decision reached the Defendant on June 13, 2013.

The details of provisional attachment on the instant goods-price claim are as follows. On June 11, 2013, the third debtor in the case number of the person holding the provisional attachment (subsan District Court) (the effective date) on the date of delivery of the amount claimed by the person holding the provisional attachment (subsan District Court) on the date of the provisional attachment decision (the date of delivery) (28,512,50 2013Kadan5435 June 13, 2013, June 26, 2013, Plaintiff 235,698, 485Kadan 2013Kadan 2013, 20285 Kadan 20285, June 28, 2013, or the total amount of the national bank 3,460, 110, 689Kadan 644, 650, 2013, 306Kadan37, 2016.

The Plaintiff filed an order for payment for the amount of KRW 235,698,485 (Seoul District Court 2013j10620) against Tech for the payment of KRW 235,69,485 (the Busan District Court 2013j10620) and the payment order was issued on June 21, 2013 and confirmed on July 18, 2013. The Plaintiff transferred the provisional seizure of the above claim on January 8, 2014 based on the above payment order to the principal seizure, and received a seizure and collection order (the Busan District Court 2014TTT168) with the content that separate seizure of KRW 21,506,646 for interest in arrears. This reached the Defendant on January 10, 2014.

A national bank may request an order of payment (Jansan District Court 2013j 11535) to pay the loan amount of KRW 4,210,110,689 against UN.
