1. The Defendant’s payment on June 20, 2018 to the Plaintiffs as stated in the separate sheet for calculation in attached Form 3.
Reasons
1. Facts of recognition;
A. The defendant is a juristic person established for the purpose of sports facility business (including the entrusted business of operation), etc., and the plaintiffs are working or retired from the defendant's workplace.
B. Of the Defendant’s employees’ annual salary rules and performance bonus rules applicable to the Plaintiffs, the main contents pertaining to the payment of wages and various allowances are as follows.
[Regulations on the Employee's Annual Salaries] Article 2 (Scope of Application) applies to a person in general service (hereinafter referred to as "employee").
Article 3 (Definitions of Terms) The definitions of terms used in this Regulation shall be as follows:
1. The term "compensation" means the sum of annual salaries and extra-annual allowances;
2. The term "annual salary" means the sum of the following basic annual salaries and performance-based incentives that are paid for the period of one year from January 1 to December 31 each year:
The term "basic annual salary" means a salary which serves as the basic basis for the adjustment of the annual salary as basic benefits related to duties.
(b) A performance-based incentive means a salary paid according to the results of the preceding year;
3. The term "monthly amount of an annual salary" means an amount calculated by dividing the annual salary by 12;
Article 5-1 (Performance-Based Annual Salaries) (1) Employees shall be paid performance-based incentives specified in attached Table 9.
(2) A performance-based incentive under paragraph (1) shall be paid by applying the payment rate in attached Table 10.
(3) The representative director shall separately determine the standards for payment of performance-based incentives.
Article 18 (Overtime Work and Holiday Work Allowances) (1) Within budgetary limits, overtime work allowances referred to in attached Table 7 shall be paid to persons who have worked outside of working hours under special circumstances.
Provided, That this shall not apply where a leave of absence is granted.
(2) Within budgetary limits, a holiday work allowance prescribed in attached Table 7 shall be paid to a person who has worked on a holiday specified by special circumstances.
Provided, That this shall not apply where a leave of absence is granted.
Article 19 ( Night Work Allowances) A person who works only at night (from 22:00 to 6:00 on the following day) and a week.
