A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

피고인은 2018. 11. 16. 23:22경 안산시 상록구 B에 있는 C마트 앞 도로를 D 벤츠 승용차를 운전하던 중, 경기안산상록경찰서 E지구대 소속 경사 F로부터 술 냄새가 심하게 나고 눈이 붉게 충혈되는 등 술에 취한 상태에서 운전을 하였다고 인정할만한 상당한 이유가 있어 음주감지기를 이용하여 음주감지하려고 하였으나, 이를 거부하고 현장을 이탈하려고 하여 음주측정에 응할 의사가 없음을 명백하게 표시하여, 도로교통법위반(음주측정거부)죄의 현행범인으로 체포되어 안산시 상록구 G 소재 E지구대로 연행되었고, 위 E지구대에서 같은 날 23:38경부터 23:53경까지 약 20분 동안 총 3회에 걸쳐 음주측정기에 호흡을 불어 넣는 방법으로 음주측정에 응할 것을 요구받았음에도 음주측정기에 입김을 불어 넣는 시늉만 하고 실제로 입김을 불어넣지 않거나, 입김을 불어넣지 않는 방법으로 거부하였다.
