The appeal is dismissed.

The grounds of appeal are examined.

For the reasons indicated in its holding, the lower court upheld the first instance judgment that acquitted the Defendant on the instant facts charged (excluding the dismissal of prosecution and the part not guilty of violating the Labor Standards Act against G) on the ground that it did not constitute a crime.

Examining the record, the above determination by the court below is justifiable.

There is no error in the misapprehension of legal principles as to the grounds for exclusion of responsibility.

On the other hand, the prosecutor appealed the entire judgment of the court below, but the part not guilty of the violation of the Labor Standards Act against G does not state the grounds for objection in the petition of appeal or the appellate brief.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
