The defendant shall be innocent.
Reasons
1. The summary of the facts charged is a person who actually operates a dance institute business after being registered as a general restaurant or service business under the trade name of Gangnam-gu Seoul Metropolitan Government D and 1 as “E”.
A person who intends to operate a sports facility business shall prepare a facility and report it to the head of a Si/Gun/Gu as prescribed by Ordinance of the Ministry of Information and Communication.
Nevertheless, from July 7, 2015 to August 9, 2016, the Defendant received approximately KRW 60,000 per month from about 70 students outside of name in the above place as tuition fees from around 70 students, and operated a dance institute business without reporting it.
2. Article 38(2)1 of the Act on the Installation and Utilization of Sports Facilities provides that a person who operates a sports facility business without filing a report under Article 20(1) of the said Act shall be punished. Of the above sports facility businesses, a dance institute business among the above sports facility businesses is “a business teaching international standard dancing curriculum after receiving tuition fees, etc.” as stipulated in attached Table 2 of Article 6 of the Enforcement Decree of the said Act.
