1. 피고인 B 피고인은 2016. 1. 16. 23:00경 위 당구장에 들어가, 술에 취하여 피해자 A을 비롯한 종원원들에게 “짜장면 가져와”라고 말하며 중국음식 주문을 해 달라고 요구하였으나 피해자가 시간이 늦어 배달주문이 불가하다고 하자 시비를 걸었고, 이에 피해자와 실랑이 하던 중 당구대 위에 있는 위험한 물건인 당구공을 손에 집어 들고 이를 피해자를 향하여 던질 듯이 팔을 휘두르면서 피해자에게 “씨발, 뭘 쳐다봐”라고 말하며 위협하였다.
