Punishment of the crime

1. Joint offenses committed by the Defendant, C, and D;

A. On September 30, 2013, the Defendant, who violated the Act on the Protection of Children and Juveniles against Sexual Abuse, was in de facto marital relationship with C, such as living together with C, giving birth to his/her child, and the victim E, at the D’s house located in Southern-gu, Nam-gu, and at the time of porting on September 15:00, came home. The Defendant and C and D had the victim have sexual intercourse with the physical males through a mobile phone display, etc., and conspired to make the victim to live in return for the said sexual traffic.

피고인과 C, D는 위 일시경 피해자에게 ‘앞으로 한 달의 기간 동안 하루 4회의 조건만남을 하고, 월 300만 원의 성매매 대가를 상납하며, 지인들에게 연락하거나 무단으로 이탈하지 않으며, 위 약속들을 어길 경우 어떠한 처벌도 받겠다’는 취지의 각서를 작성하도록 하고 “도망가다 잡히면 죽는다.”라고 말하여 마치 피해자가 위 각서의 내용대로 이행하지 않으면 위해를 가할 것처럼 행세하면서, 같은 날 21:00경 피고인은 자신의 휴대전화를 이용하여 ‘즐톡’ 애플리케이션에 접속한 후 불상의 성매수남과 성매매 약속을 하고, C과 D는 피해자로 하여금 포항시 남구 대도동 시외버스터미널 부근 불상의 모텔에서 위 성매수남을 만나 성교를 하도록 지시하여 피해자가 불상의 성매수남을 만나 성교를 한 후 그 대가로 현금 15만 원을 받아오자 이를 교부받아 생활비 등으로 사용한 것을 비롯하여 별지 범죄일람표 1 내지 6항 기재와 같이 총 6회에 걸쳐 협박으로 청소년인 피해자로 하여금 청소년의 성을 사는 행위의 상대방이 되게 하고, 그 대가인 103만 원을 받았다.
