A defendant shall be punished by imprisonment for not less than eight months.

except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On October 6, 2018, the Defendant: (a) delegated a lawyer E, etc. with the authority to file a complaint for D with a purpose of having D receive criminal punishment, and (b) ordered the said lawyer, etc. to prepare a written complaint for complaint; (c) around November 6, 2018, the Defendant submitted the written complaint to the Jeonjin-gu Police Station of Jeonjin-gu, Jeonjin-gu, Seoul; and (d) had D submit it to the Jeonjin-gu, 299.

In the above complaint, although D did not separately agree on interest rate of KRW 2.30 million between the Defendant and the Defendant on March 28, 2013, as if D had agreed to pay interest rate of KRW 0.6% per month, it forged the monetary loan contract as of March 28, 2013, and used it to bring a civil action against the Jeonju District Court on September 5, 2018, and acquired property gains equivalent to KRW 100 million and interest thereon, the above monetary loan contract as of March 28, 2013 was signed by the Defendant and D. However, there was no forgery of D that it was written by the Defendant on his own signature under the agreement of the Defendant and D.

Accordingly, the defendant reported false facts to public offices and filed a false complaint D.
