1. The Defendant: (a) from September 15, 2013 to September 15, 2013; and (b) from September 32, 762,380 to the Plaintiff, the Plaintiff’s KRW 32,762,380.
Reasons
According to Gap evidence Nos. 1 through 6 (including various numbers), witness D's testimony, and the whole purport of oral argument, the plaintiff Gap worked for the defendant company from May 1, 2012 to August 31, 2013, and the plaintiff Eul from February 10, 2012 to June 30, 2013, the plaintiff Eul paid 2.5 million won per month, and the plaintiff Eul received 3 million won per month. On October 2012, the defendant company went through financial difficulties, and all other employees retire, and the plaintiffs tried to retire from office for reasons such as the plaintiff's failure to receive proper benefits, and the plaintiff's retirement pay from 3.2 million won to 3.8 million won, and the plaintiff's retirement pay from 2.3 million won to 2.8 million won, and the plaintiff's retirement pay from 2.3 million won to 2.8 million won, and the plaintiff's retirement pay from 2.8 million won to 2.28 million won.
Therefore, the Defendant is obligated to pay to Plaintiff A KRW 31,738,802 and damages for delay calculated at the rate of 20% per annum as stipulated in the Labor Standards Act from September 15, 2013, which was the day following the 14th day after the retirement of the said Plaintiff from August 31, 2013, and from September 15, 2013, to Plaintiff B, as well as from June 30, 2013 to the day after the said Plaintiff’s retirement from June 14, 2013, respectively.
If so, all of the plaintiffs' claims are reasonable, it is decided as per Disposition by admitting them.
