1. Occurrence of liability for damages;

가. 인정 사실 C과 피고는 2018. 9. 19. 19:30경 양주시 D 아파트 관리소 입주자대표회의실에서, 입주민대표 인감도장의 보관 문제로 원고와 시비를 벌이다가, 인감도장을 갖고 있던 원고에게 ”중립을 지켜야할 감사가 왜 도장을 갖고 있냐 ”라고 말하며, 도장을 빼앗기 위해 C은 앉아 있는 원고의 등 뒤에서 그녀의 목을 감싸고 어깨를 누르며 도장을 쥐고 있는 원고의 손목을 잡고, 피고는 한 손으로 원고의 손목을 잡고 다른 한 손으로 도장을 쥔 원고의 손가락을 강제로 펴게 하였다.

We cannot accept the defendant's argument.

2. Scope of liability for damages

A. The king medical expenses: KRW 367,770 (the Plaintiff claimed KRW 556,900 equivalent to the hospital medical expenses from September 19, 2018 to December 22, 2018, however, in consideration of the degree of the instant injury, the sum of KRW 25,570,000 and the estimated value thereof is the sum of KRW 342,200,000.

(b) Future medical costs: KRW 137,760 anticipated to be incurred in the future medical costs shall be deemed to have been disbursed on the day following the date of the pronouncement of the first instance judgment, and shall be the amount converted at the present price on the date of the accident.

C. Consolation money: 200,000 won in the instant case;
