1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. The following facts are found either as a dispute between the parties or as a whole, or as a whole, the whole purport of the pleadings in Gap evidence Nos. 1, 2, 4, and Eul evidence Nos. 1 and 2 (if there are serial numbers, including their serial numbers; hereinafter the same shall apply) is recognized, there is no counter-proof.
(1) As to the construction of the instant building, etc. (1) The Plaintiff entered into a construction contract with the Gai L&C Co., Ltd. B. (1) On August 18, 2005, the Plaintiff entered into the following agreements (hereinafter “instant agreement”) with the Defendant and the Nonparty Company regarding the settlement of the Plaintiff’s claim for construction price against Nonparty Company, the trust of the instant building, etc.
