Reasons
Punishment of the crime
1. Around January 14, 2009, the Defendant against the victim F made a loan from H to the victim F who was found to pay the loan arrears at the mutual influent office operated by Defendant A located in Gwanak-gu in Seoul Special Metropolitan City, the Defendant made a loan from H to the victim F, and the victim stated to the effect that “A 10 million won can be punished by KRW 100 million per month if the 10 million Won is the one, so he/she shall be paid the loan arrears from H, and the remainder of 19.3.8 billion won, excluding the bond expenses, shall be paid at KRW 30 million per week, and the principal shall be paid at KRW 10% per month, and the interest shall be paid at KRW 30 million per month.”
However, the defendant only planned to use the above money for an individual purpose, and there was no intention or ability to pay the principal and interest to the victim after making an investment through the above money.
Around the 15th day of the same month, the Defendant, by deceiving the victim as above, received a physical card from the victim’s bank account in the name of the victim and remitted KRW 2.75 million to the I’s account, withdrawn KRW 2.68 million from the above account, and wired KRW 1,395 million to the J account on the 16th day of the same month, and acquired the total amount of KRW 1,938,00.
2. On April 2009, the criminal defendant against the victim K stated to the effect that "The defendant would receive a loan from the victim K as security and make an investment, and pay 10% interest per month after he/she received a loan from the victim K, since he/she could impose a big amount of money to make an investment in the above or the apartment because he/she could make an investment in the above or the apartment, and then he/she would repay the principal three months after the payment of the interest and pay 10% interest per month."
