1.The judgment of the first instance shall be modified as follows:
The defendants share 1/3 of 332 square meters in GJ in Pakistan to the plaintiff.
Reasons
1. Facts of recognition;
A. On June 22, 1954, G, and K completed the registration of change of ownership of 377 square meters in the Gyeonggi-gun L-gun L-gun (hereinafter “land prior to subdivision”) under the name restoration as to one third of the shares in H-gun H-gun, Gyeonggi-gun, and H-gun on June 22, 1954. On September 26, 1961, the land prior to subdivision was divided into the H-H land above on September 26, 1961; on one third of the shares in the J’s name, the ownership transfer registration was completed on December 23, 1986; on one third of the shares in the name of J; on one of the shares in the name of N-gun on December 31, 198; on one’s own name, the ownership transfer registration was completed on one third of the shares in the above M-M and N-N, and on another’s own name, on the other hand, registered on the ownership under the name of K on February 29, 29, 198.
B. On August 12, 2004, the land before subdivision and the ownership change 1) before subdivision was divided into 332 square meters (the name of the administrative district was changed as the instant land on July 25, 201) and 45 square meters, respectively, and the land before subdivision was divided into 332 square meters (the name of the administrative district was changed as the instant land on July 25, 201) and 45 square meters, respectively. (2) On August 14, 2011, the Defendants, the heir of K, as the Defendants, completed the registration of ownership transfer on February 13, 2012 with respect to each of the instant land on the grounds of inheritance by agreement division.
C. P from 1960 before December 1960, P built a househouse on the H land of Gyeonggi-gun, Gyeonggi-gun, and resided with his spouse and children, and the Plaintiff paid the remainder on December 24, 1960 to the Plaintiff, among which P had been residing on December 8, 1960, at KRW 114 (the part of P, including the land in this case, on a ledger) out of the H land of Gyeonggi-gun, Gyeonggi-gun, which is the first house site where P had been residing in P, at KRW 420 (the size of the land in this case, on a ledger). P concluded a sales contract with the Plaintiff at KRW 10,000,000 (the down payment on December 8, 1960) and the remainder on December 24, 1960.
