1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Basic facts

A. 1) The Gangdong-gu Seoul Metropolitan Government Building No. 201 Dong 207 (hereinafter “instant building”) on seven parcels outside Gangdong-gu Seoul Metropolitan Government

A) On February 21, 1989, E completed the registration of transfer, and on June 23, 2008, F completed the registration of transfer on the ground of inheritance on June 11, 2003, 3/7 of F Shares was transferred to G on the same day as on June 23, 2008, and H thereafter completed the registration of transfer on the ground of sale on the same day.

3) The Plaintiff purchased KRW 245.5 million from H. The Plaintiff determined down payment of KRW 80 million, intermediate payment of KRW 64,285,714, and the remainder of KRW 101,214,286, and the intermediate payment of KRW 90 million was replaced by H5/7 shares (64,285,714) out of the deposit for the deposit for the intermediate payment of KRW 90 million. 4) After the instant building, the Defendant’s shares in the instant building were transferred to D Housing Reconstruction Improvement Project Association (hereinafter “Building Association”) on the same day on August 25, 2015, and the Plaintiff’s shares were transferred on the same day to the Reconstruction Association on the same day on August 31, 2015.

B. On October 5, 2010, the Plaintiff entered into a lease contract with I on the instant building in KRW 100 million and entered into a contract with the Defendant, which is 2/7 shares, and thus, did not contact with the Defendant, and thus, entered into a contract with the Plaintiff and the difference between the deposit money for the previous lease and the former lease deposit amount, into a contract with the Plaintiff, and agreed again that the Plaintiff would pay the Plaintiff the amount of KRW 10 million and be responsible for the KRW 10 million, but the deposit was adjusted to KRW 90 million.

On November 22, 2010, J, a former lessee, issued a receipt of KRW 90 million to the Plaintiff.

C. The reconstruction association filed a lawsuit against the Plaintiff and the Defendant for registration of ownership transfer, etc., and the appellate court of the said lawsuit filed a lawsuit against the reconstruction association on November 22, 2012, and the Plaintiff.
