A defendant shall be punished by imprisonment for three years.
Reasons
Punishment of the crime
Co., Ltd. (hereinafter referred to as “C”) is a company under the supervision of the Ministry of Trade, Industry and Energy and is selected as a participating institution of the D Development Project (hereinafter referred to as “instant project”) which is carried out by Bosco as a main contractor, and the Defendant is its representative director.
The Defendant, throughout the fourth year from September 1, 201 to June 2013, 4.5 billion won, in total, from the Korea Evaluation Institute of Industrial Technology (i.e., the project cost of the instant project from September 1, 2010 to March 31, 201; (ii) the project cost of KRW 50 million from April 1, 201 to March 31, 201; (iii) the project cost of KRW 850 million from March 31, 201 to March 31, 2012; and (iv) the Defendant opened an account under the name of another person in the process of obtaining a false order to use research funds under the name of another person (hereinafter referred to as “the Defendant acquired a false order to use research funds”); and (iii) the Defendant did not obtain a false order to use research funds under the name of another person (hereinafter referred to as “the name of another person”).
1. Violation of the Act on the Aggravated Punishment of Specific Economic Crimes;
A. A. On September 20, 2010, the Defendant acquired the money through deception in the C Office located in Daegu Northern-gu, Daegu Northern-gu (hereinafter “G”) by means of false order from the Korea Industrial Technology Evaluation Institute to prepare a false order, etc. as if he did not place an order for “H” service in relation to the instant business, and submit it to G to the Korea Industrial Technology Evaluation Institute for payment of KRW 11,00,000,000,000 to which the Defendant is using, and acquired the money from the Daegu bank account (Account Number J) in the name of the Defendant, which is the next account in the name of the Defendant, in the same manner as indicated in the attached Table No. 1,460,566,00 won.
B. The Defendant shall acquire the project cost through E, a document company.
