1. The Plaintiff, Defendant C, and D jointly and severally, KRW 40,000,00, and the period therefor shall be from December 5, 2014 to February 9, 2015.
Reasons
1. Basic facts
A. At the time of November 30, 2012, Defendant B agreed to the effect that, among the instant buildings, the term of 101 and 102 units of the lease deposit KRW 50 million, monthly rent of KRW 2.5 million, and the term of 2.5 million from December 5, 2012 to December 4, 2014 (hereinafter “instant lease agreement”). As of the time of the instant lease agreement with F and G, the lessee agreed to the effect that “the instant lease agreement is valid for five years if it did not violate the contractual terms.”
B. On November 30, 2012, the Plaintiff, from Defendant B, agreed from Defendant B, that the instant building No. 101 was leased KRW 40 million, monthly rent of KRW 2.4 million, and the period from December 5, 2012 to December 4, 2014 (hereinafter “the instant sub-lease contract”). At the time of the instant sub-lease contract, the Plaintiff operated a restaurant, “H” at the same place thereafter, with Defendant B, under a special agreement with the owner of the building and the first lessor.
In November 30, 2012, 10 million won, and 30 million won on December 5, 2012, 2012, and 40 million won on a sublease deposit, the Plaintiff’s denial I paid to the Defendant.
C. F and G sold the instant building to Defendant C and D on September 1, 2014, and on September 12, 2014, the registration of ownership transfer was completed with respect to each of 1/2 shares of the instant building.
On November 5, 2014, Defendant C and D demanded the transfer of the instant building 101 and 102 to Defendant B and the Plaintiff until the aforementioned period on the ground that the instant lease agreement expired on December 4, 2014.
E. On December 4, 2014, the Plaintiff returned real estate to the lessor pursuant to Article 5 (Termination of the Contract) of the Commercial Building Lease Agreement, simultaneously with the expiration date of the contract on December 4, 2014 between Defendant C and D.
