A defendant shall be punished by imprisonment for not less than one year and six months.
However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.
Reasons
Punishment of the crime
The Defendant and the victim E are in conflict with each other for about four years from September 2009 to January 2013.
1. Around 13:00 on March 9, 2012, the Defendant damaged the Defendant’s property damage by leaving S1 mobile phone on his/her living room in Seo-gu, Seo-gu, 101 Dong 1403 (G building) on the Defendant’s house living room to make the Defendant’s family not suitable for the Defendant’s family. When a gallon which is equivalent to KRW 700,000 on the market price owned by the Defendant or the victim, galloned S1 mobile phone to the living room wall.
2. At around 15:00 on March 12, 2012, the Defendant: (a) stated that the mother of the Defendant was paid KRW 300,000 to the victim (the age of 22 at that time) in his/her house living room under the name of the victim’s mobile phone repair cost destroyed and damaged as prescribed in paragraph (1) on the ground that the mother of the Defendant took 300,000 won in the name of the victim’s mobile phone repair cost; and (b) stated that “the knife will receive the knife money from the Republic of Korea at the end of the knife; and (c) stated that “the knife would cause harm to the victim; and (d) made the Defendant threaten the victim to transfer KRW 300,000 to the account of his/her mother; and (e) made the mother of the Defendant transfer the knife to the H account on the same day.
Accordingly, the defendant received property by threatening the victim.
3. On December 13, 2012, the Defendant forced the victim to return the money that the victim leased prior to the towing out of the body of J located in Gwangju-dong, Gwangju-gu, on the ground that at least 15:00 on December 13, 2012, the victim’s head was returned, three times, and the hand room with the victim’s head, one time, and more than the ground floor by putting the head scam in hand, and then breaking the victim’s cell phone with the victim’s cell phone "on the victim’s cell phone" with the victim’s cell phone, and the victim’s cell phone was cut off at the victim’s cell phone, and the victim’s cell phone, with good words related to the goods, money, and the parent’s mother, a clean and a thickness to commit deep death.
