1. (i) On September 10, 2019, the Defendant’s designation of the operator of the CIndustrial Complex Development Project for the Plaintiff Co., Ltd. is revoked.

1. Details of the disposition;

A. On January 2012, the Defendant changed the name to the Ministry of Agriculture, Food and Rural Affairs according to the Government Organization Act amended by Act No. 11690 on March 23, 2013.

The Minister of Agriculture and Food Affairs (hereinafter referred to as the “Minister of Agriculture and Food Affairs”) filed an application for a subsidy program with respect to the project to create and develop agro-industrial complexes (hereinafter referred to as “first project”) in the high interest-gun D Institute, and the Minister of Agriculture and Food Department appointed the Defendant as the subsidy program subject to the subsidy program on March 15, 2012.

B. On October 2014, Plaintiff A Co., Ltd. (hereinafter “Plaintiff A”) owns 80% of the Plaintiff Co., Ltd.’s equity interest and 20% of the E Co., Ltd. as a special purpose corporation established for the first business around October 2014.

Plaintiff

A on November 24, 2014, filed an application with the Defendant for designation as a project implementer in relation to the primary project, and the Defendant designated the Plaintiff A as the project implementer on December 4, 2014.

C. The Defendant, as an indirect subsidy program operator with respect to the first project, falls under the indirect subsidy program operator with respect to the Plaintiff A, who applied for a subsidy on or around December 2014, and the indirect subsidy under Article 2 subparag. 4 of the Subsidy Management Act for the Plaintiff A on December 22, 2014.

On December 30, 2014, the decision to grant subsidies of KRW 286,00,000 has been notified and the subsidies of KRW 5,429,00,000 have been granted more than six times in total. The detailed details are as follows:
