Reasons
1. Facts of recognition;
A. Pursuant to Article 23 of the Act on the Ownership and Management of Aggregate Buildings (hereinafter “the Act”), the Defendant is a management body established with all sectional owners of B (hereinafter “the instant aggregate building”) in Osan City as members pursuant to Article 23 of the Act on the Ownership and Management of Aggregate Buildings, and the Plaintiff is a sectional owner of the instant aggregate building D.
B. After the dismissal of the head of Defendant E, the Plaintiff was appointed as the head of Defendant Management Body on November 10, 2013.
C. Around November 10, 2015, the Defendant entered into an entrustment management contract with F Co., Ltd. on the management of the instant condominium building, and F Co., Ltd. had G work as the head of the management office.
G, the head of the management office of the instant condominium building, around December 9, 2016, announced the convocation of the management body general meeting on December 16, 2016, wherein the appointment of the manager was an agenda item.
E. On December 16, 2016, the Defendant’s general meeting of management was not held, and the chairman of the election management committee was designated and notified by the head of the management office, when some sectional owners gather to hold a general meeting at the same time.
F. Around March 3, 2017 and around March 7, 2017, the chairperson of the instant aggregate building management committee (the chairperson of the instant aggregate building announced the general meeting of the management body on March 12, 2017 for the temporary composition and approval of the three management committee (the president of the temporary group H, temporary general directors I, temporary auditors J, K, temporary auditJ, K, temporary directors L, M, N,O, Plaintiff).
G. On March 12, 2017, the Defendant’s management body general meeting (hereinafter “instant meeting”) was held, and the J was appointed as the manager (head of the management body), as the auditor, and the N as the general director, and the resolution was adopted to confirm the composition of the management body of the three-year period (hereinafter “instant resolution”).
H. Relevant provisions of the Aggregate Buildings Act and the Management Rules of the Aggregate Buildings in this case (hereinafter “Management Rules”) are as shown in the attached Form.
