1. The counterclaim of this case shall be dismissed.
2. As to each real estate listed in the separate sheet, the Defendant (Counterclaim Plaintiff).
Reasons
A principal lawsuit and a counterclaim shall be deemed simultaneously.
Under the basic facts, C Co., Ltd. (hereinafter referred to as “C”) obtained a loan from the Nam Bank Co., Ltd. (hereinafter referred to as “Seoul”) on September 28, 2012 when it receives a loan from the Plaintiff on September 28, 2012 (hereinafter referred to as “Seoul Bank”) and the registration of ownership transfer under the Plaintiff’s name, as indicated in the separate sheet No. 1 of the attached list, with respect to the real estate and the partial shares of the real estate listed in paragraph 2 of the attached list No. 1 of the attached list No. 1 of the attached list No. 2890.54) and awarded a successful bid on June 4, 2010, and completed each of the above real estate and shares on June 8, 2010 with respect to the above real estate and shares, and upon receiving the loan from the Plaintiff, the Korea District Court concluded a real estate and shares trust contract with the Plaintiff on the same day and granted a preferential right to benefit from the real estate and shares under the name of the Plaintiff.
The purport of the evidence No. 2-1, No. 2, and the purport of the entire pleadings is as follows. The registration of ownership transfer in the name of the Plaintiff was completed on October 31, 2012 with respect to the remainder of shares (99.46/280) of the real estate listed in the attached Table No. 2-1, No. 2-2, and the remaining shares (99.46/28) of the real estate listed in the attached Table No. 2-1, No. 56884, Oct. 22, 2012; and the registration of ownership transfer in the name of the Plaintiff was cancelled on October 31, 2012 with respect to the whole real estate listed in the attached Table No. 56887, Dec. 22, 2012.
The evidence Nos. 2-1, 2, 2, c and F (the trade name before the change: G Co., Ltd.; hereinafter referred to as “F”) of the contract for the new construction of each real estate-based apartment on the ground stated in the attached list shall be the same as the case.
