A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

[2] On January 17, 1991, the Defendant was sentenced to imprisonment with prison labor for larceny at a prison labor force of 10 months; on February 25, 1993, the Defendant was sentenced to imprisonment with prison labor from a prison labor of 10 months; on April 29, 2004, the Defendant was sentenced to imprisonment with prison labor for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Larceny) at the Daejeon District Court on September 15, 2006; on August 22, 2012, the Defendant was sentenced to imprisonment with prison labor of 1 year and 6 months; on August 28, 2012, the Defendant was sentenced to imprisonment with prison labor from a prison labor of 1 year and 16 months; on February 28, 2012, the Defendant was finally sentenced to imprisonment with prison labor at the Incheon District Court on February 16, 201, and the judgment of 200 won became final and conclusive after the expiration of the period of larceny.

[2] On March 5, 2017, at around 14:38, the Defendant: (a) stolen the victim F, who was displayed at the “E” store located in Jung-gu Seoul, Jung-gu, Seoul; (b) by taking advantage of the gaps in surveillance of customers, the victim F, who was displayed at the store, the victim’s market price of KRW 90,000,000, which was the victim’s possession.

In addition, from around that time to March 21, 2017, the Defendant stolen wallets, etc. worth KRW 2,920,000 in total, five times in total, as indicated in the list of crimes in the attached Form.

Accordingly, the Defendant, who was sentenced to imprisonment not less than three times due to larceny, committed larceny over five times during the period of repeated crime.
