On February 26, 2010, after receiving a decision to grant subsidies from the Gyeong-si on December 23, 2010 with respect to Defendant A’s above I processing facilities expansion project, the Gyeong-si decided to grant Defendant A subsidies of KRW 700 million (50 million in national expenses, 60 million in city expenses, 140 million in Si expenses, 300 million in person expenses, 300 million in person expenses).

According to Article 2 of the Subsidy Management Act by fraudulent application or other unlawful means, “subsidies” refers to subsidies (only applicable to subsidies granted to local governments, and granted by other corporations, organizations, or individuals with facility funds or operating funds) granted by the State for the purpose of creating or providing financial assistance to affairs or projects performed by persons other than the State (Article 1). “Indirect subsidies” refers to benefits granted by persons other than the State without receiving any corresponding consideration, in whole or in part, for the purpose of granting the subsidies.
