A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Criminal facts

From December 2, 2013 to May 9, 2014, the Defendant works as H at the election campaign office of the National Assembly Candidate F (G at the National Assembly in the summer City), and performed the management of an election organization. The Defendant, while keeping the electoral register and contact information exclusively, was in charge of the election affairs for F, such as ENS (SNS) and text messages.

On January 22, 2014, the Defendant carried out the key role in planning and implementation of major election events, such as F's withdrawal declaration, F's preliminary candidate registration on February 26, 2014, and F's unification between F and I (J) on March 31, 2014.

At around 21:00 on May 6, 2014, the Defendant provided KRW 50,000, 10,000, to L, “I am ice, I am ice, I am see, I am see, I am see, I am see, I am see, I am see, I am see, I am see, I am see, I am drinking.”

On the other hand, L served as a regional executive officer of Mparty, from January 2014 to May 2014, 2014, F’s withdrawal declaration, election campaign office establishment, simplification with I, and the former N Political Party’s various events for election campaign for F, such as the merger of Seoul F. Therefore, the offer of money and valuables was related to F’s election campaign, and at the same time, it was related to the public opinion poll of Mparty’s intraparty competition intended from May 10, 2014.

Accordingly, the defendant provided money and goods in relation to the election campaign and provided money and goods to L who is a person related to the competition campaign for the purpose of selecting F as a candidate in relation to the intraparty competition.
