1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Basic facts

A. On September 14, 2017, the Plaintiff indicated each of the real estate listed in the separate sheet (hereinafter collectively referred to as “instant land”) from the Defendant on his/her behalf (whether there is power of attorney or not) by the Defendant on September 14, 2017, and indicated “the relevant parcel number” only when referring to individual land.

2) The sales contract for the purchase price of KRW 186,00,000 in total (hereinafter “instant primary sales contract”).

2) The Plaintiff paid KRW 30,000,000 in cash to C as the down payment on the day of the instant first sales contract, and KRW 29,00,000 in total with the Defendant’s account.

3) On September 15, 2017, the Defendant returned KRW 29,000,000 to C when the instant primary sales contract was null and void (the Plaintiff’s account was set back and returned to C).

(2) On September 19, 2017, C repeated payment of the above KRW 29,00,000 to the Defendant on three occasions, and C paid the above KRW 29,000 to the Defendant on September 19, 2017, and thereafter C closed its account. (2) On December 11, 2017, the Plaintiff again concluded a sales contract to purchase the instant land in total with KRW 186,00,000 (hereinafter “the second sales contract”). The purchase price of KRW 186,00,000 (hereinafter “the second sale contract”), which is KRW 186,000,000,000, KRW 200,000, KRW 300,000 (the remainder payment of KRW 186,000, KRW 600, KRW 600, KRW 6000) (the intermediate payment of KRW 20,000).
