A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[2017 Highest 3291] The Defendant obtained personal information, such as IDs, passwords, resident registration numbers, etc. from another person’s Internet account, and used it to access the Internet website “Smarket” or “Sash” in another person’s name, or to subscribe to online gift events or to receive the event goods after new subscription.

1. Violation of the Act on Promotion of Utilization of Information and Communications Network and Information Protection, etc.;

A. From November 27, 2012 to December 13, 2013, the Defendant: (a) at the Defendant’s house of 3106 and 310, the Defendant reported that he/she had access to the Internet site and posted a name in the Internet site that he/she sold the ID and password to another person; and (b) received the notice from another person, by accessing the Internet site to the Internet site’s NAV account; and (c) received information with the knowledge that he/she had received personal information from another person for the purpose of subscribing to online gift events in connection with the Internet site’s “Internet” or “Type” in the Internet site’s name or receiving this event’s goods; and (d) received the personal information from another person with knowledge that he/she had received the personal information through the NAN service (1-A) and personal information from another person via the Internet site’s account of 281, 281.

B. On December 2012, the Defendant: (a) visited the Internet site and opened an online site “market” or “house”; and (b) opened an online gift event under another person’s name, and (c) increased the number of recommending the winning rates; and (b) received a proposal and accepted it; and (c) received 1,046 resident registration numbers of other persons, such as the Meger’s list (1-B), and received her resident registration numbers from the person in a name disorder, and received personal information, with knowledge of the fact that personal information was divulged.
