1. Basic facts

A. On May 22, 2019, the Defendant entered into a contract with C (hereinafter “C”) under which the Defendant entrusted the business management of D Complex Facilities Construction Project (hereinafter “instant project”) to C (hereinafter “instant PM contract”).

The main contents of the instant PM contract are as follows.

Article 3 [Scope of Services)

1. C shall carry out the business of raising land costs, construction costs, authorization costs, etc. necessary for the instant project to be promoted by the Defendant (hereinafter “business funds”) and the business affairs necessary for the selection of financial institutions necessary therefor.

2. C shall perform the business of selecting collaborative companies necessary for carrying out the business approval of the instant project.

Article 4 (Service Period)

1. The service period shall be from May 22, 2019 to June 30, 2019, and if necessary, the defendant and C may extend the service period through mutual consultation.

2. The time-limit for raising business funds shall not exceed the duration of the contract, and the time-limit may be extended upon confirmation of the progress of the work, but C shall make its best efforts to proceed within the time-limit;

Article 5 (Service Fees and Time for Payment)

1. The defendant shall pay the service cost for the instant project promoted by C as follows:

1) Amount of services: 160 million won (excluding value-added tax) service cost payment period 2) (1) : 50 million won in preparation of the PM contract; 2) upon completion of the financial period and completion of the PF statement: 110 million won in the business feasibility report 3) : 10 million won in the service cost (excluding value-added tax, 10 million won in the service cost separately);
