Punishment of the crime

당시 피고인은 얼굴이 붉고 술 냄새가 심하게 나며 출동한 경찰관을 피해 차량 밑에 들어가 숨어 있는 등 술에 취한 상태에서 승용차를 운전하였다고 인정할 만한 상당한 이유가 있어 안양만안경찰서 소속 경장 C로부터 음주측정기에 입김을 불어넣어 음주측정에 응할 것을 요구받았으나 같은 날 02:44경과 02:55경 음주측정에 응하지 아니하고 이어 같은 날 03:28경 음주측정기에 입김을 부는 시늉만 하는 등 3회에 걸쳐 정당한 사유 없이 경찰관의 음주측정에 응하지 아니하였다.
