Defendant shall be punished by imprisonment for not less than two years and six months.

However, the execution of the above punishment for three years from the date of the final judgment.

Punishment of the crime

1. Around July 31, 2018, the Defendant violated the Act on the Protection of Children and Juveniles against Sexual Abuse (Indecent Act by compulsion) stated that the Defendant posted the Defendant’s writing on the Facebook to the effect that, even though the victim B (the name of the Defendant, the age of 16) told him/her that he/she was a high school student while in a telephone call with the Defendant, the Defendant was interviewed. The Defendant started broadcasting on the E site on the same day with the victim, who was found in the name of the building C in the front Gunsan City, the Masan City, where the Defendant broadcast was conducted, “I do not have any person at his/her age her age. I want to broadcast the Internet broadcast. I can do so even if I want to do so with the word, she can do so to the extent that I want to do so with her kis, kis, and her clothes.”

2018. 8. 4.경 범행 피고인은 2018. 8. 4. 13:00경 위 C건물 D호에서 피해자와 함께 E 인터넷 방송을 하던 중, 시청자들에게 “오늘은 세게 나갈게요.”라고 말하면서 피해자에게 티셔츠와 브래지어를 벗으라고 하고 일어나게 한 후 갑자기 피해자의 젖꼭지를 빨아 강제로 추행하고, 방송 종료 후 위와 같은 상황에 놀란 피해자가 피고인에게 “이 정도로 수위가 높은 방송은 못하겠다.”고 말하였음에도 같은 날 17:00경 다시 F 인터넷 방송을 하면서 갑자기 피해자의 가슴을 만지고 피해자로 하여금 피고인의 젖꼭지를 빨도록 시켰다.

Accordingly, the defendant committed an indecent act against the juvenile victim by force.

B.
