A defendant shall be punished by imprisonment for not less than three years and six months.

Punishment of the crime

The Defendant is a person who served as the Vice-President of the Seoul Office Co., Ltd. (hereinafter referred to as “B”) from October 201 to January 17, 2018 and has been engaged in preparation for holding the board of directors.

1. On June 22, 2017, the Defendant: (a) visited the Defendant’s computer installed at the Seoul Team Office B’s Seoul Office on the 11th floor in Seocho-gu Seoul, Seocho-gu Seoul Metropolitan Government D Building E, with the Defendant’s computer located therein; (b) proposed an application for “the maximum amount of a corporate card card increase from KRW 30 million to KRW 50 million; and (c) requested H to obtain approval from the head of the team team by inserting an application for “the maximum amount of a corporate card” with the content that the Defendant obtained from B to increase the maximum amount of use of the F card (G), which was possessed by the Defendant, from KRW 30 million; and (d) sent the said application to the employee in charge of a fund team card in charge of obtaining approval of the part under H’s name. At the same time, the Defendant sent the said application to the Defendant, who was unaware of the fact that the Defendant obtained approval of the part under H’s name.

As a result, the Defendant forged and exercised the “written application for the limit increase of corporate card” file in the H’s name, “written application for the limit increase in the amount of corporate card” in the name of H, a prior recording of rights and obligations, for the purpose of interfering with the affairs of B’s affairs without legitimate authority, from November 22, 2017 to November 22, 2017, as shown in the list of crimes (1).

2. A violation of the Act on the Aggravated Punishment, etc. of Specific Economic Crimes (Misappropriation) shall purchase the department store with the above corporate card that was received from the victim B, in mind to use it for personal purposes, such as stock investment, etc., and use the said corporate card only for the business of the victim, and shall not inflict any property damage on the victim by using it for personal purposes.
