1. The instant lawsuit shall be dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Basic facts

A. The defendant and C’s agency service contract was concluded 1) The defendant is a joint housing construction project under the Housing Act (hereinafter “instant project”) in Dongjak-gu Seoul Metropolitan Government D D D.

In order to promote the project, a regional housing association is established with the authorization of establishment of the head of Dongjak-gu Office on November 26, 2008, and C (hereinafter referred to as “C”).

- The scope of services and duties under Article 4 (Scope of Services and Duties) (1) is entrusted by the Defendant, and all the tasks to be performed by C are as follows:

1. Operations related to the Cooperative and the management of its members;

2. Affairs related to the commencement of projects;

3. Purchase of project sites, roads, and school sites;

4. Other business affairs shall pay, within three months after authorization for the establishment of an association, the amount equivalent to C within 30 percent of the actual input amount in return for the services performed by C in accordance with the purchase of land and construction works on securing access roads for the project, school gymnasiums, project site purchase, authorization or permission process, etc. under Article 7 (Fees for Services).

Article 8 (Business Promotion Expenses) (1) C shall be paid KRW 15 million per household from the defendant's members in the name of business promotion expenses.

2. The business promotion expenses set forth in paragraph 1 above shall be collected directly from the defendant's members by opening an account in the name of C alone, and shall be used at will by C, and shall not be settled separately to the defendant.

Article 9 (Project Costs, Provision of Land, and Settlement) (1) C shall include funds necessary to carry out the duties set forth in paragraph 1 of Article 4 above and the duties relating to the Project of the Association, and shall settle accounts of funds made from financial rights when funds relating to this project are loaned from financial rights.

(2) With respect to paragraph (1) above, if C requests the defendant to pay the unpaid amount which the defendant has not completed within three months after authorization was granted to establish the association, the defendant shall pay it immediately.
