A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.

Punishment of the crime

The Defendant committed each of the following crimes under the status that the Defendant was unable to discern things or make decisions due to dementia, etc. on the boom of behavior changes:

[2018 Highest 2362] Around 16:00 on May 25, 2018, the Defendant driven a Jworka car without a driver’s license and proceeded to the front part of the NM5 car driven by the victim (51 years old) on the front side of the road in Gwangju Southern-gu, along with the one-lane of the road in front of the road in the south-gu, Gwangju National University. The Defendant was negligent in performing the duty of care to safely drive the vehicle by failing to perform the duty of care, such as accurately operating the steering direction and brake system, and driving the central line on the right side, while neglecting the duty of care to safely drive the vehicle.
