피고인은 2018. 6. 30. 06:00경 익산시 ‘B원룸’ C호 전여자친구인 D의 집에서, D이 피해자 E(29세)과 몰래 만났다는 이유로 화가 나 피고인이 사용하는 휴대전화기를 이용해 피해자에게 전화를 걸어, ① ‘너는 씹할 놈아 내가 너 같은 놈 손 댈 거 같냐, 어린애들 씹할 스무살 짜리한테 한 대 쳐 맞아봐, 어디냐고 좆만한 새끼야, 개 쌩양아치 같은 새끼를 씹할 놈이 니가 내 이름 들으면 개새끼야 이 바닥에 돌아다닐 수 있을 것 같애 좆만한 새끼야, 어디냐고 니미 보지 씹할 년아 니 모텔 가서 시발 쥐어박아 죽여 버리기 전에’, ② ‘말해라 지금 어디냐 니미 보지 씹할 새끼야 너는 부산 산다고 했지, 너는 씹할 년아 너는 봐봐 너 익산바닥에서 내가 너 모텔 다, 애들 시켜가지고 모텔 시켜서라도 씹할 년아’, ③ ‘너 지금 이 시간 한 시간 안에 너 나 5분 안 보면 너는 지금 너 지금 나 안 본 거 후회하게 될 거야’ 라고 말을 하며 마치 피해자의 생명과 신체에 어떠한 위해를 가할 것처럼 겁을 주었다.
