1. The Defendant (Counterclaim Plaintiff) paid KRW 439,592,182 to the Plaintiff (Counterclaim Defendant) and its related amount from February 9, 2015 to November 5, 2015.
Reasons
1. Basic facts
A. 1) The Plaintiff is a company with the purpose of redevelopment and reconstruction-related specialized management projects. 2) The Defendant is a housing redevelopment and maintenance project association under the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents (hereinafter “Urban Improvement Act”) established for the purpose of implementing housing redevelopment improvement projects (hereinafter “instant improvement projects”) in the area of 630 square meters and 207,527 square meters in Mapo-dong, Mapo-gu, Seoul.
After obtaining authorization for establishment from the head of Mapo-gu on September 1, 2006, the Defendant received authorization for project implementation on August 27, 2007, and the authorization for project implementation on May 16, 2008.
B. 1) On December 18, 2006, the Defendant entered into a specialized management service contract for the instant rearrangement project with the Plaintiff, a city and our PMF, and ABD Co., Ltd (hereinafter “instant 1 service contract”).
(1) The service amount under the first service contract of this case shall be KRW 5.1 billion per square year multiplied by the total floor area of the rearrangement zone determined and announced publicly by the 38,00 won per square year (excluding value-added tax). Article 2 (Business Apportionment and Cooperation Obligation), Article 2 (Business Apportionment and Cooperation Obligation), Section B, and Section C shall share the following duties and cooperate in order to achieve the objectives of this project:
(2) The ratio of shares in paragraph (1) applies to the allocation of costs for rearrangement project management projects by the cooperative, the allocation of costs for the management of rearrangement projects by the cooperative, the allocation of basic tasks by each company, and the cost for the provision of services, etc.
