1. Revocation of the first instance judgment.
2. The Defendant’s charges for compelling the performance against the Plaintiff on October 16, 2017 KRW 15,052,80.
Reasons
1. Details of the disposition;
A. On August 21, 2015, the Plaintiff obtained a building permit from the Defendant, and newly constructed a detached house (multi-family house) of the fourth floor size on Seongbuk-gu Seoul Metropolitan Government and C ground (hereinafter “instant building”) on February 18, 2016, and obtained approval for use (site area: 184.8 square meters, total floor area: 302.24 square meters, building area: 110.5 square meters, parking lot: 4 houses (in two houses, outdoor two houses)).
B. In order to keep the wheelchairs used by both the Plaintiff and the Plaintiff, who are physically disabled persons, and both the Plaintiff and the Plaintiff use each wheelchairs as physically disabled persons. Since it is difficult for the Plaintiff to have the wheelchairs once each with the second floor of the instant building, it is necessary to keep the wheelchairs on the first floor.
별지1 평면도와 같이 이 사건 건물 1층 부분 일부에 샌드위치 패널의 칸막이를 설치하는 방법으로 물품보관창고를 무단증축하는 한편(별지1 하단 평면도의 ‘ㄱ’자 형태 ‘무단증축 부분’), 위 무단증축 결과 그 증축 부분에 당초 주차장으로 건축허가 및 사용승인을 받은 별지1 하단 평면도의 ▨부분이 포함되자 주차장 부분의 주차구획 세로선을 오른쪽으로 20cm씩 이동시켰다.
C. On May 2017, the Defendant received a civil petition for the said unauthorized extension, etc., and imposed the charge for compelling compliance on the Plaintiff pursuant to Articles 19, 79(1), 80(1)1, and 80-2(1)2 of the Building Act with respect to the said unauthorized extension, and Article 115-4(1) and (2) of the Enforcement Decree of the Building Act, 853,750 won for compelling compliance [the standard market price = 683,00 won x 5m2 x 5m2 x 5m2 x 0.5m2 x 0.5m2].
그리고 피고는 별지1 하단 평면도의 ▨부분 주차장의 용도변경에 관하여 주차장법 제19조의4 제1항을 위반하였다는 이유로 2017. 6.경 및 2017. 7.경 2회에 걸쳐 원고에게 원상회복명령을 한 다음(시정기한 2017. 7. 3.까지 및 2017. 8. 28.까지) 2017. 9...
