A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

The Defendant, who worked in the branch office of C, a multilevel health and food selling company, was introduced as “E” from a person attending the same church on October 2013, after introducing the victim D, among real estate, from a person who was enrolled in the same church, and was introduced as a victim D, and then selling the victim’s actual name and another “E” to the victim at KRW 3 billion. The Defendant: “I wish to arrange for purchase of the 2nd floor in Busan High-gun, Busan High-gun, for the purchase of the said company’s product at KRW 2 billion.” “B is working in the branch office of C, a multilevel health and food selling company, with the highest class in C, which is a multilevel health and food selling company, and is receiving the above company’s premium every month; and, upon purchasing the above company’s product, I wish to receive the allowance from the said company; and let the victim receive the money for the purchase of the company’s product from the victim.”

1. On November 25, 2013, the Defendant made a false statement to the victim, “If the Defendant purchases an amount equivalent to KRW 10 million in the name of the President, he/she would register the Plaintiff as a member of the de facto class of the multi-stage company he/she works and would receive 70% of the sales amount as monthly allowances, and if there is no money, he/she would also make payment by credit card.”

However, at the time, the Defendant prepared cash through a prompt name card tin (the fact that there is no commodity transaction but the credit card was settled through the fictitious sale, and then the settlement is allowed with the exception of some commissions) with the payment of the credit card from the victim, and there was no intention or ability to receive the payment of the company's allowance to the victim by purchasing the above company's product in the name of the victim.

The Defendant is the victim as above.
