Defendant shall be punished by a fine of KRW 2,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

1. The Defendant in violation of the Copyright Act is a person who runs “is publishing D” in Kim Jong-si.

On December 26, 2012, the Defendant produced and published the books of “F” under the name of “E” at the office of “is” in the book publishing D, and copied the parts of “I” among the contents of “H” in copyright to the victim G by using the same as “I” (Articles 286 through 303) without permission, and distributed 50 copies of the above book, thereby infringing on the victim’s author’s property right.

B. On December 26, 2014, the Defendant produced and published the books of “J” under the name of “E” at the “D office for publication of books,” and made and published the books of “J”.

The “I” portion of the “I” portion was reproduced by citing it without permission (Article 286, 288, 289, 291, 293, and 295) and distributed the said 300 copies and infringed on the author’s property right of the victim.

2. 정보통신망이용촉진및정보보호등에관한법률위반(명예훼손) 피고인은 2015. 1. 9.경 아산시 K에 있는 주택에서 증산도 교인인 L과 대화하면서, 위 피해자를 비방할 목적으로, “응, G! 걔도 성품이 안됐어! 오입도 좋아하고! 그 새끼 참! 지금 우리가 도덕 사회를 구축하는데 벌써 인간적인 처세에서 도리에 어긋나면 그건 잘못된 거에요. 여자를 무척 좋아해. 암만 젊다고 해도 그건 잘못된 거야. 처녀를 몇 명 건드렸어! 벌써!”라고 말하는 장면을 촬영한 뒤, 이를 피고인의 제자인 M으로 하여금 인터넷 유투브(www.youtube.com) 사이트에 접속하여 ‘N’이라는 제목으로 게시하도록 하였다.
