The judgment below

Examining the evidence duly admitted by the first instance court, which maintained the reasoning of the judgment below, the court below was just in finding the Defendant guilty of the facts charged of this case on the grounds as stated in its reasoning. Contrary to the allegations in the grounds of appeal, the court below did not err by misapprehending the legal principles as to legitimate act, self-defense, and Article 16 (Misunderstanding of Law) of the Criminal Act, by failing to exhaust all necessary deliberations and by failing to exhaust all necessary deliberations

In addition, even after examining the record, the court below did not err in infringing the criminal defendant's right to a trial due to errors such as denying the application for resumption of pleadings as alleged in the grounds of appeal.

All other grounds of appeal are not legitimate grounds of appeal under Article 383 of the Criminal Procedure Act.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
