Reasons
Punishment of the crime
On February 1, 2008, the Defendant engaged in the business with the victim H in Ulsan-gu G, Ulsan-gu, and was to operate the J (representative K) wholesale market company (representative K) with the intention to be supplied with scrap metal from Dorael Co., Ltd. (Representative I), and around March 11, 2008, the Defendant got transferred KRW 300 million to the agricultural bank account in the name of the Defendant’s mother to be used for KRW 300 million in the scrap metal supply contract amount with Dorael Co., Ltd. from the victim, and the Defendant decided to conduct the scrap metal business.
1. On April 2, 2008, the Defendant received KRW 100 million from the victim’s office located in Ulsan-gu, Ulsan-gu, Seoul-do, at the end of the end of April, 2008, from the victim’s office, the amount of KRW 100,000,000 from the victim’s account at the Seosan-gu, Ulsan-gu, U.S., U.S., U.S. A. A. L. to the account at the U.S. Hanel bank account.
However, on April 16, 2008, the Defendant paid only KRW 150 million among the above KRW 300,000,000,000, which was paid as a deposit for a scrap metal supply contract with Dorael Co., Ltd. from the victim, to I as part of the deposit for a scrap metal supply contract, and made a false statement that there was a lack of KRW 100,000,000 out of KRW 150,000,000, which was paid as the remainder as a deposit for a scrap metal supply contract from I for the purpose of raising the fund.
Accordingly, the Defendant received 100 million won in the name of the additional deposit for the supply of scrap metal from the victim I, as above, from the victim, via the transfer of 100 million won in the name of the additional deposit for the supply of scrap metal from I, and used it as the balance of 300 million won in the deposit for the supply contract of scrap metal to Doel Hana Bank Co., Ltd., thereby acquiring economic benefits equivalent
2. Around September 2008, the Defendant terminated a scrap metal supply contract with Dorael Co., Ltd.
