A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.

Punishment of the crime

around January 15, 2015, the Defendant stated that “The victim D, the representative director of the Jongno-gu Seoul Sejong Cultural Center, will subcontract the construction work of electricity and machinery and equipment to C Co., Ltd., the construction work of the F Co., Ltd., the E Co., Ltd., the construction cost of which is KRW 70,000,000, is required and repaid until February 28, 2015.”

However, the Defendant had no particular property at the time, but failed to pay 25 million won value added, and even if concluding a contract to subcontract the construction of electricity and machinery and equipment on behalf of E Co., Ltd. to E Co., Ltd. for the construction of F Housing, the lower-level contract was not properly implemented because it was not clearly planned to secure funds, such as bank loans necessary for the progress of construction of F Housing, and the Defendant, who is not the said F Co., Ltd., was working for the Defendant, not the said F Co., Ltd.

G Reconstruction Corporation only thought to be used as funds necessary for the G Reconstruction Corporation, and there was no obvious change in the payment of the borrowed money from the damaged party, and there was no intention or ability to repay it.

Accordingly, the Defendant, as seen above, had the victim enticed and had the victim receive 70 million won check from the victim, i.e., the victim, for the borrowed money.
