The defendant's appeal is dismissed.
Reasons
1. Summary of grounds for appeal;
A. misunderstanding of facts or misunderstanding of legal principles 1) Mampacam (i.e., a single philopopon; hereinafter referred to as “philopon”).
(2) As to the violation of the Act on the Control of Narcotics, etc. (hereinafter “Act on the Control of Narcotics, etc.”) due to sale, the Defendant did not sell B a 0.7g philopon to B on the date indicated in this part of the facts charged. (2) As the Defendant’s violation of the Act on the Control of Narcotics, etc. (e.g., the violation of the Act on the Control of Narcotics, etc.) due to the philopon medication, the date, place, and method of the administration of philopon is not specified, this part of the facts charged cannot be deemed to have been specified. 2. Determination
A. 1) Determination of misunderstanding of facts or misunderstanding of legal principles as to the violation of the Act on the Control of Narcotics, etc. (fence) due to the sale of phiphones, and the defendant also asserted as the grounds for appeal in the court below, and the court below rejected the defendant's assertion on the grounds of the same circumstances as the judgment of the court below 2nd 8 to 19. In light of the above judgment of the court below, the judgment of the court below is just and it is not erroneous and there is no error of law as alleged by the defendant. Therefore, this part of the defendant's assertion is not acceptable. 2) As to the violation of the Act on the Control of Narcotics, etc. (fence) due to the administration of phiphones, etc.
