1. The Defendant amounting to KRW 14,682,942 to the Plaintiff and KRW 5% per annum from September 8, 2016 to September 22, 2016.

The following facts do not conflict between the parties, or are acknowledged in full view of the purport of the entire pleadings as stated in the evidence Nos. 1, 2, 2-1, 3-2, 3-1, 4-1, 2, 5-1, 8, 9-1 through 3, 9-3, and 2, and 5-1, 5-2, 5-1, 8, 9-1 through 3, and 2, and there is no counter-proof.

On July 16, 2014, Nonparty C was sentenced to the Chuncheon District Court Decision 2014Gahap369 decided July 16, 2014 that the Defendant paid to Nonparty C the amount of KRW 95,00,000 and the amount calculated at the rate of KRW 20% per annum from July 1, 2013 to the date of full payment (hereinafter “instant judgment”), and the said judgment became final and conclusive around that time.

B. On January 30, 2015, the Plaintiff was issued a decision on provisional seizure of claims against the Defendant of Nonparty C pursuant to the instant delegation contract concluded on October 2013 between the Plaintiff and Nonparty C, with the claim for the agreed amounting to KRW 9,880,00 according to the instant delegation contract concluded on January 30, 2015. The instant provisional seizure order was served on the Defendant on February 4, 2015.

C. On January 27, 2016, the Plaintiff: (a) was delegated to Nonparty C and Nonparty C with the affairs related to provisional attachment, provisional disposition, and principal lawsuit on October 2013; and (b) was entitled to claim the retainer and contingent remuneration agreed upon around January 27, 2016; (c) Nonparty C paid the Plaintiff the annual amount of KRW 49,738,684 from December 16, 2014 to January 27, 2016; and (d) paid the annual amount of KRW 15 percent from the following day to the date of full payment; and (c) was entitled to provisional execution of the obligation to pay the said amount (hereinafter “instant first instance judgment”).

On April 15, 2015, the Plaintiff rendered a provisional attachment order against Nonparty C’s non-party Nong Bank Co., Ltd. and Hana Bank Co., Ltd. on the provisional attachment of claims by the Chuncheon District Court 2015Kadan356.
