A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

On January 11, 2013, the Defendant was sentenced to imprisonment with prison labor for two years and six months for violating the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (indecent act by force among relatives), and the execution of the above punishment was terminated on March 6, 2015. On February 21, 2014, the Defendant was ordered to attach an electronic tracking device for seven years at the Gangnam Branch Branch of the Chuncheon District Court.

On March 29, 2015, the Defendant was a person who attached a location tracking device (hereinafter referred to as “electronic device”) upon completion of the execution of a labor force in the 3rd North Korean Prison on March 29, 2015.

On the other hand, electronic device means a series of mechanical devices that confirm the location or detect the moving route using the principle of transmitting and tracking electromagnetic waves, comprised of ① “on-site tracking device” (a device carried by a person with an electronic device attached, which confirms the location of the electronic device through the satellite location verification system and mobile communication network), ② “on-site monitoring device” (a device assisting the tracking device installed in the residence of the electronic device subject to attachment, which confirms the location of the electronic device) and ③ “on-site monitoring device (a device installed in the residence of the person subject to attachment)” (a device that transmits electromagnetic waves to the portable tracking device and the home supervisory device by attaching the body of the person subject to attachment).

A person who has an electronic device attached (hereinafter referred to as "person subject to attachment") shall not arbitrarily separate, damage, or otherwise impair the electronic device from his/her body during the period of attachment of the electronic device, and shall charge, carry, or manage the electronic device so that the function of the electronic device can be maintained normally during the period of attachment of the electronic device.

1. On March 30, 2015, the Defendant committed the crime of March 30, 2015, at around 09:35, the Defendant went missing for approximately 4 hours and 50 minutes on the following grounds: (a) on March 30, 2015, the signal of the “portable portable portable device” was missing because the Defendant did not charge the “portable tracking device” in the front city of Gangwon-si, Gangwon-si, but did not charge it.
