Defendant shall be punished by a fine of two million won.

If the defendant does not pay the above fine, KRW 100,000.

Punishment of the crime

The Defendant attempted to deliver or disseminate music programs (one-name nuclear program) that can be favorable to normal users than normal users by injecting any code that carries out illegal orders with C'(one-person type Sing Game) Game and C'E(one-person type Sing Game) Data provided by the KCAB, and by means of purchasing and selling the music program (one-name nuclear program) that can be favorable to ordinary users and its certification code from other sellers.

No person who violates the Act on Promotion of Utilization of Information and Communications Network and Information Protection, etc. shall damage, destroy, alter, or forge an information and communications system, data, program, etc., or convey or distribute a program that may interfere with operation thereof without any justifiable ground.

Nevertheless, at around 17:55 on April 18, 2019, the Defendant sold and distributed a “malicious” program by receiving KRW 9,000 from “G”, which is a hosting program, to H in the name of the Defendant, and transmitting a “nuclear program” and a “nuclear certification code to implement the “nuclear” in the same manner as selling the program, including selling the program. From March 31, 2019 to June 20, 2019, the Defendant sold and distributed the program by receiving KRW 417,150 in total 44 times, as shown in the attached list of crimes.

(b) No person who violates the Game Industry Promotion Act shall distribute computer programs, apparatus or device not provided or approved by game products related business entities for the purpose of interfering with the normal operation of game products, or produce them for the purpose of distribution;

Nevertheless, the above Defendant, like the above, is JAB and E game, which is a C Game Development Company.
