A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

The defendant is a licensed real estate agent who runs real estate brokerage business under the trade name of "Seoul Young-gun Licensed Real Estate Agent."

When the Defendant came to know that D intended to sell “the instant land” of 10,942 square meters or less in Yong-gun, Young-gun, Chungcheongnam-gun, the Defendant concluded a sales contract for the said land and paid 10 million won as the down payment on the same day after concluding a sales contract for the said land, as if D acted as agent for a third party, raising profit margin by selling unregistered pre-sale to a third party. Around September 16, 2009, the Defendant concluded a contract to purchase the instant land from D at D’s house located in Young-gun, Young-gun, Chungcheongnam-gun, Chungcheongnam-gun, and paid 10 million won as the down payment.

1. Forgery of private documents and the uttering of falsified investigation documents;

A. On September 20, 2009, the Defendant: (a) within the above C Licensed Real Estate Agent Office; (b) there was no authority delegated by D to sell the instant land exclusively; and (c) instead, D goes through another broker; (d) sells the instant land to a third party; and (e) sells the instant land to a third party as if D’s agent; and (c) sells unregistered and unregistered land; (d) indicated on the paper of the exclusive brokerage request agreement that was prepared for the purpose of exercising, “the location of the object: Ep. Ep. 1,942 square meters; and (e) indicated in the effective period as “from September 2009 to December 19, 2009”; and (e) stated as “B’s act on behalf of others free of charge; and (e) indicated as “HD’s name and address name” and “BD’s name and address name” as “BD’s name and address column,” respectively.

In addition, the defendant has been prepared for the purpose of exercising the same reason at the same time and place as above.
